LoudASP products are sold 'as is'. LoudASP (and its owners) offers no warranty that the product(s) will satisfy a particular need or purpose of the recipient.

Whilst every reasonable care has been taken to ensure the accuracy of the information contained in the product(s), the facts, estimates and opinions stated therein are based on information and sources that, while LoudASP (and its owners) believes them to be reliable, are not guaranteed.

While due care is taken in developing LoudASP product(s), it is provided as is. LoudASP, its owners, its directors or employees, or authors of the product(s) makes no warranty, expressed or implied, with regard to the product(s) and accepts no liability for any loss occasioned to any person or entity acting or failing to act as a result of anything contained in or omitted from the product(s).

It is LoudASP (and its owners) policy to undertake legal action against infringers of LoudASP (and its owners) copyright in order to protect LoudASP (and its owners) rights.

All prices are stated in United States Dollars. All payments are non-refundable.

All transactions are online transactions. LoudASP products are delivered immediately upon download. LoudASP (and its owners) is not responsible for the recipient's operating system or software. If the recipient experiences a problem with downloading LoudASP product(s), the recipient shall contact LoudASP within 24 hours.

The recipient accepts all the risks associated with credit card payments. LoudASP (and its owners) uses third parties to validate online transactions. LoudASP (and its owners) shall not be held liable for any error with respect to validation.

The recipient warrants that the purchase information provided to LoudASP, its owners and its nominated third parties is accurate. The recipient shall indemnify LoudASP (and its owners) against all losses, costs, expenses, damages and liabilities incurred by LoudASP (and its owners) as the result of any claim or action brought by a third party for any incorrect information supplied by the recipient.

End User License Agreement (EULA)

• Your license is non-transferable or refundable or exchangeable.

To be eligible for technical support and to ensure that you are notified of any future updates, you are required to register a valid email address and be in full compliance with this EULA. Technical support is provided on the original product and DOES NOT include support on the modification of the original source code. LoudASP may undertake technical support on the modification of the original source code on a fee-for-service basis.

This software is provided as is. LoudASP makes no warranty, expressed or implied, with regard to the software. All implied warranties, including the warranties of merchantability and fitness for a particular use, are hereby excluded. We make no promises that our software/products will meet your needs.

LoudASP provides its product(s) "as is" and makes no warranty. In no event shall LoudASP, its owners, its directors or employees, its authors, or partners be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, and/or other pecuniary loss) arising out of a use or inability to use this product, even if advised of the possibility of such damages. Loudasp is not responsible for any damage done, directly or indirectly, to your system(s), computer(s), network(s), or any other third party system(s).

Due to the open source nature of our products and the medium that they reside in we cannot grant refunds for cash or anything of value. ALL SALES ARE FINAL.

In the case of Educational or Governmental Agencies who wish to run FingerTips "as is" or "as modified" may contact us to work out a separate agreement. Developers License do not cover multi-site Educational or Governmental Agencies because the issue that arises when FingerTips is installed on more then one domain even if that domain is a sub-domain of a larger domain. Running FingerTips on a sub-domain is allowed provided the sub-domain is still reasonably part of the main domain. Different departments or organization with in an entity do not qualify for being part of the site that the original license was purchased for.

Privacy Statement

Your personal information: what do we collect, and how do we use it?

• We do not collect personal information when you visit our site unless you log on, place an order or register with us.
• When you place an order you will be asked for the following personal information: your name, e-mail address, mailing address, delivery address and any special delivery instructions, contact number(s). We may share this information, and only that information which is absolutely necessary, with those third parties that are involved in the processing of your order. For example, the financial institution that issued your credit card and the shipping carrier that delivers your order.
• LoudASP is committed to reducing the amount of fraud it faces. Our policy is that we will prosecute any cases of fraud that we identify. As a first time customer, you may receive a telephone call or email requesting more information/proof to confirm the details that you have supplied to us. If any of the information you supply is found to be false or misleading, we will, if we deem it appropriate, report this to the appropriate authorities for them to prosecute.
• We do not share, sell, rent or barter any identifiable personal information to any third party without your permission.
• When you log on to our site, we will ask you your user ID, which is usually your email address.
• If you belong to a participating Club, we may send information about specials we are offering to Club members. We may ask for information which identifies you as a club member. There will be an option to unsubscribe to such information, if you do not wish to receive it.
• We have specials and clearance emails available to make your shopping and purchasing experience easier. Should you decide to subscribe, we will send you your requested information from time to time. You may unsubscribe at any time. Subscription to this service is optional and free.
• When you submit feedback or questions via e-mail, or contact us for information about our Web site, we will request your name and e-mail address. We use this information solely to respond to your inquiries.
• When you enter a contest or other promotional feature, we may ask for your name, address, and e-mail address so we can administer the contest and notify winners. We may ask for other information to enable us to improve our site or to send you special offers.
• Our site contains links to other sites. LoudASP is not responsible for the privacy practices or the content of other Web sites.
• By default all web server log files capture IP addresses. We may use your IP to help diagnose problems with our server, administer our web site and to track web usage. This information is used internally and is not shared with anyone else, unless required by law or utilised in the prosecution of fraud.

Your personal information: what do we collect, and how do we use it?
A cookie is a small amount of information sent from a Web server to your computer. We use cookies when someone logs into our site, to maintain that log in, to retain log in information, if requested, and for the service of our shopping basket. We do not use cookies for marketing, promotional or advertising purposes, nor do we use cookies to track your Internet activity before or after you leave LoudASP. Any activity while you are at LoudASP may be monitored. Your computer will only store a maximum of 2kb of cookies. They are deleted on a first in first out basis. No other company has access to our cookies.

Emails from LoudASP
LoudASP has found that attractive, graphics-rich emails are a quick, effective and low-cost way to communicate with customers and prospects about new high tech products, clearance and auction items. We maintain an opt-out, user-customizable subscription service of email addresses of people requesting promotional emails. We do not want to send emails to you if you would prefer not to receive them. Therefore, every email provides a way for you to unsubscribe from future emails. In addition, you can visit our web site. We also have administrative procedures in place to remove email addresses and domains that consistently send failure messages to our email servers.

Security
For credit card transactions, LoudASP adds security by using Secure Sockets Layer (SSL) technology. This means that the credit card information you send is encrypted by your computer, and then decrypted again on our side, preventing others from accessing your private information in between. So, when using an SSL capable browser, shopping on LoudASP's web site is the safest kind of transaction possible with a credit card.
